How to appeal against a planning decision
Summary
If we haven’t made a decision on your planning application within the right space of time (eight or thirteen weeks), or you are not happy with the decision we have made, then you can appeal. To do this you need to contact the Planning Inspectorate, the Government Agency set up to process all planning and enforcement appeals.
Further information
There are strict time limits on your right to appeal, and if you make an appeal outside these time limits the chances are it will be turned away by the Planning Inspectorate.
The deadline for submitting an appeal is now six months from the date of the application decision letter (2 months for advertisement consent) - or if your application was never determined, six months from the date the decision should have been made). From the 6 April 2009 any appeal against the refusal of a Householder application will now need to be submitted within 12 weeks (3 months) from the date of the decision. For more information on this new “Householder Appeal Service” please visit the Planning Inspectorate’s website under 'External Links' below.
Appeals can take several months to decide and they can be costly. Before considering making an appeal, please contact us to see whether any changes to your proposal could make it more acceptable.
The Planning Inspectorate website has two excellent guides which can be downloaded, called ‘Making your planning appeal’ and ‘Guide to taking part in planning appeals’. The National Planning Portal also has guidance on the appeals process – follow the links under ‘External links’ below.
