High Court dismisses challenge to Gypsy site enforcement

Mr Justice Ouseley has today dismissed an application for Judicial Review brought against South Norfolk Council.
The Council had decided to take direct action to bring about compliance with planning enforcement notices.
The applicant, Lisa Smith, together with other Romany Gypsies have occupied as a caravan site, the land at Middle Road, Denton, since October 2003, without planning permission.
In September, the Council granted a Gypsy site planning permission to the same Gypsies on land elsewhere at Rushall Road, Harleston. That land is in the ownership of the Council.
Earlier this week, the Council's Cabinet deferred any decision on whether to provide the site at Rushall Road, pending clarification of previous Norfolk County Council highways advice currently being investigated by highways officers.
Council Solicitor Stuart Shortman said the Council would be giving careful consideration to the full judgement.
