Council welcomes early court hearing on Denton
Released on 25 July 2006
South Norfolk Council has welcomed the granting of an early full hearing of the court challenge concerning the Gypsies at Denton.
Gypsy site occupant, Lisa Smith, lodged a challenge against the Council for its refusal to delay enforcement action while an appeal against a further planning refusal is made.
Mr Justice Collins, sitting in the High Court, granted South Norfolk Council's application for a full hearing, which was not opposed. The hearing will be held during the summer break on 21 August.
Stuart Shortman, Solicitor to the Council said:
"Whilst we did not invite the challenge to our decision making, we are pleased that any period of uncertainty will be kept to a minimum. That must be in the interests of the site occupants and also of the local residents, who are affected by the current use of the site."
